Fees
Attorney fees are based on the situation of your case. Do you own real estate? Do you have children? What kind of assets do you own? How long have you been married? There are a number of questions that must be addressed. Call the office to set up a time to come in. We can discuss your situation and you will be given a quote for a retainer.
Representation
We are allowed to represent one party. Under the rules that govern our conduct as lawyers, we may not represent both parties. We can only provide advice to one party, our client.
Child Support
If you have children of your marriage, one party will most likely be paying child support. Child support cannot be waived and the parties are not allowed to simply come up with a number and agree on that amount. The Court must be provided with detailed financial information and that information will determine the amount of support.
Child Custody Options
There are three custody options: joint physical care, split physical care, or primary physical care to one parent. Every case is different. There are many factors that play into the determination of custody, thus a full discussion would need to be had with one of our attorneys to provide you with some guidance.
How long does the process take?
There is a 90 day waiting period from the day the service of the papers is made on your spouse. In certain cases, it may take much longer. For instance, if you are not in agreement to resolve all issues, it can take months.
Spousal Support
There is no magical answer to whether a party may receive spousal support (alimony). There are many factors that play into this and a full discussion would need to be had with one of our attorneys to provide you with some guidance.
